These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Vishal Sharma, doing business as Vikirna Mediatek (VAT/GST: 09AOUPS3687K1ZQ) ("Company," "we," "us," or "our").

These Terms govern your access to and use of vikirna.com, the IT-ES portal hosting.vikirna.com, and our services encompassing Drone Manufacturing, 3D Printing & PCB Design, Smart Home IoT, Web Architecture, and Publishing solutions. By accessing our services, you expressly agree to be bound by these Terms and our Privacy Policy.

1. Regulatory Compliance & Applicable Laws

Your use of our digital and physical services is subject to, and governed by, the following Indian statutes and frameworks:

• The Information Technology Act, 2000 (and its subsequent amendments) governing electronic contracts and digital signatures.
• The Digital Personal Data Protection (DPDP) Act, 2023 governing the collection and processing of digital personal data.
• Consumer Protection (E-Commerce) Rules, 2020 regulating our digital storefronts and Superstore transactions.

2. Multi-Division Terms of Service

Division 01: Drone Manufacturing & Commercial Operations

All Unmanned Aerial Vehicle (UAV) manufacturing, imports, and commercial flight operations are conducted strictly under the guidelines of the Directorate General of Civil Aviation (DGCA). Aerial mapping, thermal inspections, and cinematic flights are contingent upon local air-space clearances (via DigitalSky), favorable weather conditions, and adherence to no-fly zone restrictions. Vikirna Mediatek reserves the right to postpone or cancel flights if safety or regulatory parameters are compromised.

Division 02: 3D Printing & PCB Design

Clients submitting CAD files, STL files, or PCB schematics represent and warrant that they hold the intellectual property rights for the submitted designs. Vikirna Mediatek guarantees confidentiality of proprietary designs but limits liability regarding the functional end-use of rapid prototypes. Manufacturing tolerances adhere to standard additive manufacturing and PCB routing specifications.

Division 03: Smart Home & IoT Installations

Physical hardware automation relies on the client providing uninterrupted network access (Wi-Fi/LAN) and stable power. Vikirna Mediatek is not liable for service interruptions caused by third-party Internet Service Providers (ISPs) or electrical grid failures. Hardware warranties adhere to the original manufacturer's standards (e.g., Matter, Zigbee certified devices).

Division 04: IT-ES & Superstore Hosting

Cloud and hosting services are provisioned via AgraHost infrastructure. We maintain a 99.9% uptime target. By utilizing hosting.vikirna.com, you agree to our Acceptable Use Policy (AUP). Users are strictly prohibited from hosting abusive, illegal, pirated, or malicious software. Violation of the AUP will result in immediate termination of services without refund.

Division 05: Publishing & Print Media

Authors and corporate clients maintain full intellectual property rights to their original manuscripts and materials. By engaging our publishing services, you grant Vikirna Mediatek the necessary, limited authorizations to edit, format, print, and distribute the work as explicitly contracted. The client assumes final liability for proofreading approvals prior to commercial print runs.

3. Purchases, Auto-Renewals & Currencies

Payments for physical hardware, consultation services, and Superstore subscriptions are securely accepted via Razorpay, PayPal, Debit/Credit Cards, and UPI. Transactions are processed in INR (₹) or USD ($) depending on your billing locale.

Subscription Auto-Renewal: Cloud hosting, domains, and SaaS products purchased via the Superstore renew automatically. You consent to recurring charges to your payment method unless the service is explicitly canceled via your client control panel prior to the renewal date.

4. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Vikirna Mediatek and its proprietors shall not be liable for any indirect, consequential, incidental, or punitive damages arising from your use of our hardware or digital services. You agree to indemnify and hold harmless Vikirna Mediatek against any claims, losses, or legal demands resulting from your breach of these Terms or your violation of any third-party rights.

5. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any legal disputes, claims, or controversies arising out of or relating to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the competent courts located in Agra and Lucknow, Uttar Pradesh, India.
